This is a hypothetical question. Say suppose there's a car in the far left lane on the interstate who's going too slow (too slow includes the speed limit or just 5 over) and is holding up faster traffic. Someone with impatient and road rage passes in the lane to the right with limited space and cuts off the driver in the left lane or cut in too soon forcing the driver to swerve and hit a concrete wall and lost control and was injured. But there was NO contact with the other car. Who's at fault?
Now I'm going to tell you what I think. In my opinion, the car in the left lane is to blame for driving in the left lane too slow. If the car would hurry up and pass, the road rage driver won't have road rage and do an aggressive lane change. So therefore, no accident.
Unless there is an unbiased witness, it's a single car accident, and that driver of the single car is held to be at fault.
That's because, you wouldn't BELIEVE the number of single car accidents, where there's a "phantom" other driver but no contact. People will make up all kinds of excuses, yes, they lie about there being another car - to try to avoid getting in trouble.
