So I found a relatively nice place to share a room in their basement. I want to hold the place for me and move in next month so I put down security deposit. Situation changes I found a nicer place near there with more appealing price. So I definitely want to switch. I think I can do so because there was no written lease or agreement with the other place so I would be considered a tenant at will meaning either party can terminate the rent any time. Also the security deposit is for the rent that I may owe in the future or to cover severe damage to the property. When I asked for a refund of security deposit he said no and since then never bothers to answer my phone call. So what can I do now that he doesn't response to my request for a refund of security deposit? Am I at all protected by the laws?
No. He took the place off the market in anticipation of you moving in. You sealed the promise to move in when you handed over the money. The nature of any deposit is that you follow through or forfeit the deposit.
